Our standard contingent NO CURE-NO FEE commission ratio is 15% in-house for claims inside the United States and 20% for claims in foreign countries. For very small claims under $500.00 USD we change a commission rate of 25% since we often work as hard on those claims as we do on the standard larger ones as we have limited leverage. In addition once a case is assigned to our offices for debt collection, any payments that are made by the debtor either to your office or to our office are fully commissionable. That is why we accept to work on cases on a contingent fee basis. We therefore have a vested interest in the case until a resolution is finalized. That means that even if you do not feel that a payment was received as a a direct result of our internal efforts nevertheless once we work on a case without compensation, all payments are therefore commissionable. We also do a lot of international work and are presently handling cases in Latin America, Europe, India and Asia.
Fee Schedule for Commercial Claims against Companies
If no recovery is made – no commission is charged. Should a claim be forwarded to local counsel and litigation is not required, we will pay the attorney’s collection commission from our fee.
CLAIMS UNDER $25,000.00 USD: 20% OF ANY AMOUNTS RECOVERED
CLAIMS BETWEEN $25,000.00 USD AND $100,000.00 USD: 15% IN-HOUSE COLLECTION COMMISSION OF ANY AMOUNTS RECOVERED
CLAIMS OVER $100,000.00 USD: 10% IN-HOUSE COLLECTION COMMISSION OF ANY AMOUNTS RECOVERED
These rates are based upon the TOTAL COLLECTABILITY of each case. For example, the 25% commission rate applies to any monies collected under $25,000.00 regardless of the original dollar amount owed.
CLAIMS OUTSIDE OF THE UNITED STATES: 25% IN-HOUSE COLLECTION COMMISSION OF ANY AMOUNTS RECOVERED. This slight raise in commission is necessary due to the costs involved in pursuing collection outside the United States, such as faxes, telephone calls, etc.
On RETAIL CLAIMS against individuals, the commission charged would be 30% in-house and 50% if the claim requires handling by an attorney. Should the debtor be located outside of the United States, we then must increase the collection commission to 35% due to the added costs involved.
LEGAL ACTION AGAINST COMPANIES:
No legal action will be commenced without your written authorization. Court costs will be required, which will be added to the amount of any judgment entered against the debtor. Attorneys are also entitled to receive a suit fee, which does not exceed 10%, part of which may be required in advance. This is in addition to the collection commission, which is paid from our fee. You must calculate that you will lose approximately 35% to attorney/collection fees for commercial claims. On large dollar amounts, we will attempt to negotiate a lower commission rate and suit fee with the attorney and these cases will be handled on an individual basis. Once a claim is placed with this agency, it cannot be unilaterally withdrawn except under very unusual circumstances. Please remember we are accepting these cases on a contingent fee basis and, therefore, if a claim is withdrawn prior to our conclusion of all collection efforts, we reserve the right to bill you for our time and expenses incurred. In addition, we are entitled to receive commission on any payments made directly to the creditor after placement of a claim, whether the creditor believes that payment was a direct result of our efforts or not.
